Instrument Service Agreement
- Scope of Service: Melodica agrees to perform the service for the customer as specified in the work order. During the service process, if the technician discovers any additional issues with the instrument, the Customer will be informed about these findings. The Customer will have the option to agree to add the service for addressing the additional issues.
In such cases, Melodica will provide a new quotation detailing the cost and scope of the additional service. The Customer may review and approve the new quotation before Melodica proceeds with the additional work. Any changes or additions to the original work order will be documented and agreed upon by both parties in writing before implementation. - Inspection and Condition Reporting: Melodica will conduct an inspection of the instrument(s) upon receipt from the Customer or before commencing the service. The customer will be requested to sign an inspection form, acknowledging the condition of the instrument at the start of the service.
- Hand-Over and Take-Over Process: Upon completion of the service, Melodica will facilitate a hand-over and take-over process and will then request to sign the form, confirming the successful completion of the service and the acceptance of the instrument in its serviced condition.
- Service Fee and Payment: The Customer agrees to pay the agreed-upon service fee in AED as specified in the quotation on work order. Payment shall be made through a card or online payment method before the service is provided.
- Turnaround Time: Melodica shall make reasonable efforts to complete the instrument service within the estimated turnaround time provided to the Customer. However, the turnaround time is subject to change based on the complexity of the service and the availability of replacement parts, if required.
- Replacement Parts and Materials: If replacement parts or materials are necessary for the service, the Customer may choose to provide the necessary replacement parts or materials for the service. Alternatively, Melodica can produce the required replacement parts or materials on behalf of the Customer. In case Melodica provides the material, the Customer will be informed of the material fee before proceeding with the purchase and the material fee will be added to the final service fee.
- Limitation of Liability: Melodica will provide a warranty for the service for a specified period from the completion date. The warranty will cover the specific service performed by Melodica during this period.
7.1 The Customer is responsible for adhering to the terms and conditions of this Agreement to avail the service warranty.
7.2 The Customer must retain and secure a copy of the purchase invoice or work order as proof of the service. Failure to provide a valid proof of purchase may result in the denial of any warranty claims.
7.3 The warranty is valid only for the original Customer and is non-transferable to any third party.
7.4 The warranty shall be void if the instrument undergoes repairs or alterations by any party other than Melodica during the warranty period.
7.5 Melodica shall not be liable for any damages or malfunctions that arise from the Customer’s failure to comply with the terms and conditions of this Agreement or any improper use or maintenance of the instrument.
- Governing Law and Jurisdiction: This Agreement shall be governed by the laws of United Arab Emirates. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.
